China Trademark Registration & Brand Protection for US, UK & Global Brands

China is a first-to-file country: whoever registers first wins – even against the original brand owner. US and UK brands routinely lose their own names to trademark squatters. Register before you regret it.

💡

Why Register a Trademark in China?

China follows a first-to-file trademark system, meaning the first person to register a trademark owns it. Without registration, your brand can be registered by others, preventing you from legally using your own brand name in China. Early trademark registration protects your brand across all product categories.

China Trademark Questions from Global Brands

Answers to the questions brands ask most about first-to-file registration, CNIPA, the Madrid System and squatters.

Why do I need trademark registration in China?
China follows first-to-file: whoever registers the mark first with CNIPA owns it – even if that is a trademark squatter. Without your own registration, you risk market exclusion and costly litigation to get your brand back.
How long does trademark registration take?
CNIPA registration typically takes 9-12 months. Expedited examination is available when needed. We track progress and handle office actions for you.
What is the Madrid System?
The Madrid System lets you extend a US or EU trademark to China with one international application via USPTO or EUIPO. However, direct CNIPA national filings are often more robust against attacks – we recommend the best strategy.
How do I protect my brand on Alibaba and other online platforms?
With a registered Chinese trademark, you can report and remove counterfeits on Alibaba, Tmall and JD. Customs IP recordal additionally lets Chinese customs seize fakes at the border.
Can I use my existing US/EU trademark in China?
No. A US or EU trademark offers no protection in China – only national registrations count. Your existing mark gives you no automatic rights in China; separate registration is mandatory.
How do I monitor for trademark infringement in China?
We monitor the CNIPA register and online platforms for similar marks and counterfeits. When violations appear, we file oppositions or enforcement actions – both preventive and reactive.
